PREAMBLE

The General Terms and Conditions set out herein are applicable to legal operations in connection with products commercialized by to its clients on Couteaux Services' virtual boutique.

DEFINITIONS :
The following words and expressions shall have the following meaning within the context hereof
Internet Boutique: shall designate Couteaux Services's Internet site on which the Products are presented and sold to clients.
Sales Order: shall designate the sales contract concluded between and the client of 's Internet Boutique.
Product Index Card: shall designate all existing information pertaining to a product furnished by at the time said product is marketed on the Internet Boutique.
Products: shall designate all goods and services sold by Couteaux Services on 's Internet Boutique.
Service: shall designate the selling of Products by Couteaux Services to clients of 's Internet Boutique.
Transaction: shall designate all operations, secure processing, authorizations and agreements related to the payment of the price of Products ordered by credit card.
ARTICLE 1 - PURPOSE
The purpose of the General Terms contained herein is to define the terms and conditions according to which offers and sells Products to its clients.
These General Terms and Conditions of Sale shall prevail over any other terms and conditions contained in any other document, unless expressly stated otherwise in writing.

ARTICLE 2 - ACCEPTANCE OF THE CONDITIONS
The client declares that he/she is of legal age and that he/she has read and understood, at the time of placing the Sales Order, the present General Terms and Conditions of Sale and that he/she fully accepts them.
ARTICLE 3 - PRODUCTS
The majority of products offered by Couteaux Services to its clients are immediately available. All Products set out in the Sales Order transmitted to Couteaux Services are strictly reserved for personal use by the client or the recipient explicitly mentioned under the recipient address information.

ARTICLE 4 - PLACING AN ORDER
The automatic registration system will be considered as proof of the nature, content and date of the Sales Order.
Couteaux Services will confirm the acceptance of the Sales Order by sending a confirmation message to the client's e-mail address. The sale will only be completed once the Sales Order confirmation has been sent.
Couteaux Services reserves the right to refuse or cancel any Sales Order placed by its clients in the event of their insolvency or in the event of non-payment of the Sales Order in question, or in the event of a dispute concerning the payment of a previous Sales Order.
The client is exclusively responsible for any information that he or she provides when making the Sales Order. Purchase orders and invoices are archived on a reliable, durable and secure medium that can be used as proof if necessary.
The sales documents are considered as proof of the transactions carried out, and are archived by Store Factory. Couteaux Services can provide a double of the purchase orders or invoices of sale on simple request.


ARTICLE 5 - DELIVERY
Once the Sales Order has been confirmed, and subject to full payment of the Product(s) ordered by the client, Couteaux Services will ship the Product(s), under responsibility, to the client or recipients address within workdays.
In the event of immediate unavailability, either due to a temporary stock shortage, or in the case of orders for large quantities, Couteaux Services will advise the customer of the expected delivery time if it exceeds one week, the maximum delivery time being 30 days. The customer will then be free to choose a similar item, or to cancel the order, and Couteaux Services will immediately refund the amount paid, using the same payment method as the one used for the initial transaction, unless otherwise agreed. In any case, this refund will not incur any costs for the customer.
For deliveries outside of France, the delivery times vary depending on the destination, and the buyer will be informed of this when the order is confirmed.
If applicable, the customer agrees to pay upon receipt, all taxes, duties, fees and other charges due under the delivery of the products themselves; Couteaux Services can at no time be held responsible for this.
The delivery will be made by the post office, in Colissimo or "Lettre Suivie".

Upon receipt of the Products ordered, the client or recipient shall verify the proper functioning of the goods delivered and shall take note of the conditions of use indicated on the instructions provided.

In the event that one or more of the Products ordered are missing or damaged, the customer or recipient must make any reservations with the carrier at the time of delivery. The Customer or recipient will also notify Couteaux Services upon receipt of the shipment.
War, riot, fire, strikes, accidents and the impossibility of being supplied are considered as cases of force majeure discharging Couteaux Services from its obligation to deliver.
In the event that the client wishes to ship the Product(s) to another address in the country where the Product(s) are located, the client will be informed in writing.
Should the client require delivery of the Products ordered to two different addresses, two separate Sales Orders must be placed.

ARTICLE 6 - WITHDRAWAL
Pursuant to Law No. 2014-344 of March 17, 2014 on the new European regulations on distance selling, new legal provisions will be applicable as of June 13, 2014, including the right of withdrawal.
Terms of application of the right of withdrawal:
The deadline for exercising the right of withdrawal is 14 days, starting from the receipt of the goods by the buyer. In the case of orders including various articles delivered in several times: the period will run at the reception of the last good.
To exercise this right, the buyer will not need to motivate his decision, and will address his request using the withdrawal form that was sent by email with his purchase invoice when the order was shipped, and available on request to Couteaux Services.
In return, Couteaux Services will send without delay an acknowledgement of receipt of the withdrawal, by email.
The return costs will be charged to the buyer
The buyer will be required to return the goods within 14 days from the date of withdrawal request.
According to the law in force, "The responsibility of the buyer is engaged only with regard to the depreciation of the good resulting from handling other than those necessary to establish the nature, the characteristics and the good functioning of this good". The equipment must therefore be returned in its original packaging, intact, without any traces of use or excessive handling making it unfit for sale, accompanied by all accessories, user manuals and documentation.
In order to avoid any dispute, application of discount or refusal of refund, the buyer will make sure to respect these conditions of return.
The merchant will proceed with the refund as soon as the goods are returned and their condition is verified.
The refund will concern the totality of the paid sums, including the expenses of delivery in the case where the return results from an error of delivery on behalf of the salesman, or of a defect noted on the products.
In the case of a simple purchase renunciation, only the value of the goods will be refunded.
The refund will be made using the same means of payment as the one used by the buyer for the initial transaction (unless previously agreed between the two parties).

ARTICLE 7 - PRICE
The price is expressed in euros.
The price indicated on the Product Sheets does not include shipping costs.
The price indicated in the Order Confirmation is the definitive price, including all taxes and including VAT. This price includes the price of the products, the handling, packaging and storage costs of the products.

ARTICLE 8 - PAYMENT
The price invoiced to the Client is the price indicated on the Sales Order confirmation sent by .
The price of the Product(s) is payable in cash by one of the methods of payment available on the Site on the day the order is placed.
Protection against fraudulent use of the payment methods used for the transaction, notably as a result of piracy, or against possible disputes concerning payment of the Sales Order price, is ensured by Credit Mutuel through its Cybermut solution.
The Sales Order validated by the client will only be considered effective once the secured bank payment center has given its agreement on the transaction.
In the event that the secure payment center refuses to accept the transaction, the Sales Order will be automatically cancelled and the client will be informed by e-mail.
The information related to your order is subject to automated data processing for which Crédit Mutuel is responsible. The purpose of this automated data processing is to define a level of analysis of a transaction and to fight against credit card fraud.
Crédit Mutuel and the merchant from whom you make your purchase are the recipients of the data related to your order. The non-transmission of data related to your order prevents the completion and analysis of your transaction.
The occurrence of an unpaid order due to fraudulent use of a bank card will result in the registration of the data related to your order associated with this unpaid order in a payment incident file implemented by Credit Mutuel using its Cybermut solution. An irregular declaration or an anomaly may also be subject to a specific treatment.


ARTICLE 9 - APPLICABLE LAW
The present general conditions of sale are subject to French law.

ARTICLE 10 - LIABILITY
shall not be held liable for bodily or material damages incurred to any third party resulting from improper functioning or use of the Products. The same applies to any modification of the Products by the manufacturer.
The liability of the Couteaux Services shall in any event be limited to the amount of the order and shall not be held liable for any errors or omissions in the content. In the event that difficulties arise in connection with the application of this contract, the Customer and Couteaux Services reserve the right to seek an amicable solution before bringing any legal action.
Failing that, for commercial customers, the Commercial Court of Strasbourg has sole jurisdiction, regardless of the place of delivery and the method of payment accepted.

ARTICLE 11 - GUARANTEE
In no event shall Couteaux Services be held liable for any damages incurred as a result of non-compliance with the laws in force in the country where the Products are received. The liability of the shall be systematically limited to the value of the Products held liable at the date of sale, and with no possibility for filing claims against the brand name or Product manufacturer.
In any case, the customer benefits from the legal guarantee of eviction and hidden defects provided for in articles 1625 and following of the Civil Code.

ARTICLE 12 - LEGAL INFORMATION
The information of the personal information collected for the purposes of the remote sale is obligatory, this information being essential for the treatment and the routing of the orders, the establishment of the invoices and the contracts of guarantee. Failure to provide this information will result in the non-validation of the Order.
In accordance with the French "Informatique et Libertés" law, the processing of personal information concerning the client has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL).
The customer has the right to access, modify, rectify and delete data concerning him/her (article 34 of the law of January 6, 1978). Furthermore, Couteaux Services will not communicate, free of charge or in exchange for payment, the contact information of its customers to third parties.

ARTICLE 13 - SALES TO PROFESSIONALS
All companies subject to VAT can, if they wish to acquire products present on the "Couteaux Services" website.
To do so, they just have to introduce a request for a quote or information by email, specifying their exact coordinates (address, telephone, name of the person to contact).
